The Management Board of Industrial Parks (IPs) carries out its tasks and exercises its authority in accordance with legal regulations, delegation of powers from competent authorities, and other tasks and authorities assigned by the provincial People's Committee (PPC), as specified below:

Tasks and Authority of the Management Board

The Management Board of Industrial Parks (IPs) carries out its tasks and exercises its authority in accordance with legal regulations, delegation of powers from competent authorities, and other tasks and authorities assigned by the provincial People's Committee (PPC), as specified below:

Participation in providing opinions, contributing to the formulation, and submission for approval by relevant ministries, inter-ministerial agencies, and the PPC of the following tasks:
a) Providing opinions to ministries, inter-ministerial agencies, and the PPC in drafting legal documents, policies, and development plans related to IPs.
b) Advising and assisting the PPC in reporting to the Party's Standing Committee of the PPC for guidance on the implementation of assigned management tasks.
c) Chairing and coordinating with relevant agencies to develop coordination regulations with specialized agencies under the PPC or relevant agencies to implement tasks and authorities assigned through the one-stop and inter-agency single-window mechanism, submitting for approval by the PPC;
d) Chairing and coordinating with relevant agencies and organizations to develop general planning tasks and plans, zoning plans for the construction of IPs, tasks and plans for adjusting the overall planning of these plans, submitting for approval by the PPC;
e) Developing programs and plans for promoting investment in the development of IPs for approval by the PPC;
f) Synthesizing and evaluating the demand for labor in IPs, coordinating with competent state agencies to supply labor to enterprises in IPs;
g) Estimating the budget, operational funds, and annual development investment capital and other financial sources (if any) of the Management Board for submission to competent state authorities for approval in accordance with the law on state budget, laws on public investment, and other relevant legal regulations;
h) Coordinating with relevant agencies to conduct technology assessment of investment projects, evaluate the technological level and capacity of enterprises; inspecting, controlling technology transfer in investment projects, research and development activities, and application of technology by enterprises.
The Management Board performs the following tasks:
a) Managing, disseminating, guiding, inspecting, and supervising the implementation of regulations, development plans, construction planning, and related plans approved by competent state authorities regarding IPs;
b) Implementing the tasks of the investment registration agency, the Management Board according to the provisions of investment laws for investment projects in IPs under the jurisdiction of the Management Board; monitoring and evaluating the attraction of investment into each type of supported IPs, specialized IPs, high-tech IPs, eco IPs by industry, attracting investment registered as stipulated in point a, clause 3, Article 32 and point a, clause 2, Article 38; monitoring and evaluating the implementation of regulations in Clause 5, Article 8, Clause 3, Article 9, and point c, clause 2, Article 27 of Decree 35/2022/ND-CP dated May 28, 2022, of the Government on the management of industrial parks, economic zones;
c) Conducting project appraisal and design, construction budget estimation for projects, construction works within IPs; inspecting various construction works within the management responsibility and performing other tasks of specialized construction agencies as regulated by construction laws for projects, construction works within IPs;
d) Granting, reissuing, adjusting, extending, revoking establishment permits for representative offices and terminating activities of representative offices of foreign organizations, traders headquartered in IPs as prescribed by commercial laws;
e) Granting, reissuing, extending, revoking labor permits and confirming foreign workers not subject to labor permit issuance for foreigners working in IPs;
f) Implementing some tasks and authorities of the labor management agency under the provincial People's Committee regarding labor working in IPs, including: organizing labor rule registration; reporting labor usage situation; receiving reports on the use of foreign labor, reports on labor changes through the national public service portal; receiving and processing registration dossiers for implementing internship contracts of enterprise interns, activities of sending workers abroad for internships under 90 days for enterprises in IPs; receiving reports on labor leasing, training results, annual skills upgrading; notifying organizations of overtime work from over 200 hours to 300 hours per year of enterprises in industrial parks;
g) Assuming responsibility for environmental protection in IPs as regulated by environmental protection laws;
h) Receiving registration of price frameworks and infrastructure usage fees from investors implementing investment projects for construction and business infrastructure of IPs;
i) Inspecting, supervising, evaluating the implementation of investment objectives stipulated in the investment approval decision, investment registration certificate, capital contribution progress, and project implementation; compliance with commitments for projects enjoying investment incentives and compliance with regulations on construction, labor, wages, social insurance, protecting legitimate rights and interests of workers and employers, ensuring labor safety, sanitation, fire prevention, security, order, environmental protection for projects in IPs;
j) Coordinating with police units and other competent authorities in inspecting the implementation of mass movements to protect national security, maintain security, order, fire prevention, environmental protection; building and proposing measures to implement mass movements to protect national security, ensure security, order, organize security forces, firefighting forces within IPs;
k) Resolving difficulties, obstacles of investors in IPs and proposing to the Prime Minister, relevant ministries, inter-ministerial agencies, and provincial People's Committee to address issues beyond jurisdiction;
l) Receiving quarterly, annual statistical reports, financial reports of enterprises in IPs; evaluating the socio-economic effectiveness of IPs; directly managing and operating the information system about IPs;
m) Coordinating with the Ministry of Planning and Investment in building and managing the national information system about IPs under the jurisdiction;
n) Reporting quarterly, annually to the Ministry of Planning and Investment and the provincial People's Committee on the situation of: construction and development of IPs; receiving, granting, adjusting, revoking investment registration certificates, approving investment project proposals; project implementation activities; fulfilling obligations to the State; implementing labor laws and environmental protection measures in IPs;
o) Supporting, providing information for IPs' enterprises to link, cooperate with each other to implement industrial symbiosis, cleaner production measures, transition to eco IPs;
p) Organizing emulation movements and rewards for enterprises in IPs;
q) Inspecting, resolving complaints, denunciations, preventing corruption, waste, negativity, and handling administrative violations within IPs in areas under the direct management functions of the Management Board; coordinating with competent state agencies to perform inspection tasks according to legal regulations;
r) Performing tasks according to legal regulations and regulations of the provincial People's Committee on financial management, property management, assigned budgets; collecting and managing the use of fees, charges; conducting scientific research, applying scientific and technological advances; cooperating with domestic and foreign organizations, individuals in areas related to investment, construction, and development of IPs; managing organizational structure, staffing, civil servants, public employees, and training, fostering expertise for civil servants, public employees of the Management Board;
s) Performing the central advisory tasks to assist the provincial People's Committee in building plans, management, supporting transformation, and developing new types of IPs;
t) Performing other tasks and authorities as stipulated in Decree 35/2022/ND-CP, other relevant legal regulations, and assigned by the provincial People's Committee;
u) Performing other tasks according to the delegation, authorization of the provincial People's Committee.
